CBI gets 3 days to question Shah in jail
AHMEDABAD: A special CBI court on Monday granted three days to the investigating agency to interrogate former Gujarat minister of state for home Amit Shah in Sabarmati Central Jail.
Shah's lawyers initially sought time to reply to the application on the ground that they would bring in a senior counsel. The hearing was then scheduled at 3 pm. Senior counsel Nirupam Nanavati arrived with advocate Mitesh Amin, but the hearing could not be started because senior counsel Ram Jethmalani was to argue for Shah.
The proceeding was delayed due to a power cut. Finally, Jethmalani reached the court room and began his arguments. Jethmalani immediately made it clear that he could not oppose the CBI's prayer to question Shah in jail. But he began with blaming the Congress for its alleged manipulation of facts in legal proceedings and cited the example of the Godhra train burning incident. He argued that the Sohrabuddin Sheikh fake encounter case was just another one for the Congress to target political opponents.
He also contended that CBI should have given time to Shah to explain himself. He also argued that CBI must supply a copy of the chargesheet immediately, else Shah would exercise his right to remain silent during interrogation.
He proposed to the court that Shah would speak only if CBI provided him with a chargesheet. CBI lawyers Ejaz Khan and D S Salve insisted that CBI had the right to question the accused in judicial custody.

After hearing both sides, special CBI magistrate A I Rawal allowed the agency to question Shah in jail from July 28 to 30. He directed CBI to give a copy of the chargesheet to Shah as soon as possible.
